For most people in the legal world, being cited by the U.S. Supreme Court — by both sides, nonetheless — is the ultimate compliment. For Hovenkamp, it’s nothing new. He estimates he’s been cited in 35 cases — this is the fourth case this year — with about 150 citations total, because some opinions contain several citations.
“I always like to get cited, and I get cited pretty much more than anything else,” he said. “I’ve written a lot, and so as a result, justices on both sides can usually find something in what I’ve written to support their claims.”
In the most recent case, Hovenkamp said he thinks both justices cited his work accurately. Legal questions are not open and shut; policy conclusions and decisions can vary, he said.
